Kinumpirma ngayon ng Office of the Deputy Executive Secretary for Legal Affairs na tinanggal na ni Pangulong Rodrigo Duterte si Energy Regulatory Commission (ERC) chairman and chief executive officer (CEO) Atty. Jose Vicente Salazar dahil sa isyu ng korupsyon.
Batay sa desisyong nilagdaan ni Executive Sec. Salvador Medialdea noong nakaraang Biyernes, napatunayan ng Office of the President (OP) na nagkasala si Atty. Salazar sa dalawang counts ng Simple Misconduct at isang count ng Grave Misconduct.
Kaakibat ng parusang dismissal ang permanenteng diskuwalipikasyon kay Salazar na humawak pa ng public office at pagbawi sa lahat ng retirement benefits.
Pinagbasehan ng desisyon ang mga ebidensyang nagpapakitang inimpluwensiyahan umano ni Salazar ang procurement process o pagbili para sa audio visual project ng ERC para matiyak daw na makuha ng pinapaboran nitong supplier ang kontrata.
Maliban dito, napatunayan din umano ng OP na kinamkam ni Salazar ang kapangyarihan ng ERC bilang isang collegial body nang napalabas ng ilang kautusang walang imprimatur o pagsang-ayon ng ibang commissioners.
Ang chairman at CEO ng ERC ay isang presidential appointee kaya may kapangyarihan ang pangulo para imbestigahan at tanggalin ito sa trabaho.
“In line with the President’s promise to render the nation corruption free, he has dismissed from service the Chairman and Chief Executive Officer (CEO) of the Energy Regulatory Commission (ERC) who is a presidential appointee. In the Decision signed by the Executive Secretary last Friday, the Office of the President has found Atty. Jose Vicente B. Salazar administratively liable for two (2) counts of Simple Misconduct and one (1) count of Grave Misconduct. The dismissal from Grave Misconduct carries with it all accessory penalties, including the perpetual disqualification from holding public office and forfeiture of retirement benefits,” bahagi ng OES statement.
“Substantial evidence shows that Atty. Salazar tried various ways of influencing the process for the procurement of ERC’s audio visual project to ensure that his favored supplier gets the contract. It was also undisputed that Atty. Salazar usurped the power of the ERC as a collegial body when he unilaterally issued orders in connection with the application for the renewal of the Electric Power Purchase Agreements between FDC Utilities, Inc. – Misamis and several distribution utilities, and when he appointed certain ERC officials and employees without the imprimatur of the other Commissioner. Thus, the President’s decision,” dagdag ng pahayag ng OES.
