Ombudsman dismissal order vs Garcia ‘politically-motivated’ – Palasyo

Kumbinsido ang Malacañang na pulitika ang motibo sa dismissal order na ibinaba ng Office of the Ombudsman laban kay House Deputy Speaker Gwendolyn Garcia dahil sa kasong graft.

Sinabi ni Presidential Spokesman Harry Roque, bagama’t iginagalang ng Malacañang ang desisyon ng Ombudsman laban kay Garcia na kaalyado ng administrasyon, kaduda-duda naman ang timing.

Ayon kay Roque, ipinapaubaya nila sa Ombudsman ang pagdetermina sa merito ng kaso ni Garcia pero naniniwala silang dapat nailabas ito sa mas naangkop na panahon.

Kasabay nito, inihayag ni Roque na tanging ang liderato ng Kongreso ang makapagpatalsik sa kanilang miyembro sa pamamagitan ng botong two-thirds sa plenaryo.

Naniniwala si Roque na kung hindi ipatutupad ng Kongreso ang dismissal order ng Ombudsman kay Garcia ay hindi ito maaalis sa pagiging kongresista.

“While we respect the findings of the Ombudsman based on the merits of the case, only Congress may suspend or remove its members based on the former’s anti-graft and corruption rulings. She cannot arrogate this power of Congress. Thus, only the House of Representatives, convened in plenary and by a two-thirds vote, can expel Deputy Speaker Garcia from its rolls. It is also unfortunate that the decision of the Ombudsman was released at a time when such actions could be given political color,” ani Sec. Roque.

“While we leave the merits of the case to the Ombudsman, the release of the decision could have come at a more circumspect time.”
